These Terms & Conditions ("Terms") govern your access to and use of Qihome (the "App"). By using the App, you agree to these Terms. If you do not agree, do not use the App.
1. What Qihome does
Qihome lets you upload a room photo to (a) receive a feng shui score, (b) generate an optimized version of the photo, and (c) explore interior style changes and color palette variations. Outputs are generated by AI and are provided for inspiration and informational purposes only.
2. No professional advice
Qihome does not provide professional architectural, engineering, contractor, safety, medical, legal, or other regulated advice. You are responsible for decisions you make based on App outputs. Always verify suitability, safety, measurements, compliance, and feasibility with qualified professionals.
3. Eligibility and account
You can use Qihome without creating an account or logging in. You must use the App only if you are legally permitted to do so in your location.
4. Free access and subscriptions
Qihome offers free access with limited features or usage. Full access requires a paid subscription. Prices, features, and limits may change over time. Subscription terms (billing cycle, renewal, cancellation, and refunds) are handled through the platform where you purchased the subscription (e.g., Apple App Store or Google Play) and are subject to that platform's rules.
5. Acceptable use
You agree not to misuse the App. For example, you must not: (a) upload content you do not have the right to use; (b) upload illegal, harmful, or infringing content; (c) attempt to reverse engineer, disrupt, or bypass usage limits; (d) use the App to generate or distribute content that violates applicable laws or third-party rights.
6. Your content and permissions
You may upload room photos ("User Content") for analysis and generation. You represent and warrant that you have all necessary rights to upload and process the User Content. You grant Qihome a limited, non-exclusive license to process User Content solely to provide the App's features, troubleshoot, and maintain the service as described in the Privacy Policy.
7. AI outputs
AI-generated scores, edits, redesigns, and suggestions may be inaccurate, incomplete, or unsuitable for your situation. You are responsible for reviewing outputs before using them. You understand that similar outputs may be generated for other users.
8. Third-party services
Qihome uses third-party AI services (including OpenAI and Gemini) to generate the feng shui score and image outputs. Your inputs may be transmitted to these providers for processing as described in the Privacy Policy.
9. Data retention
Qihome does not store uploaded photos or generated images on our servers. Images are processed in memory solely to provide the App's features and are not persisted after your request is complete. See the Privacy Policy for details.
10. Availability and changes
We may modify, suspend, or discontinue any part of the App at any time, including features, limits, and supported styles. We do not guarantee uninterrupted availability or error-free operation.
11. Intellectual property
The App (including its software, design, and branding) is owned by Qihome and/or its licensors and is protected by intellectual property laws. These Terms do not grant you any ownership rights in the App.
12. Disclaimers
To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of liability
To the maximum extent permitted by law, Qihome and its affiliates, officers, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the App. To the extent permitted by law, Qihome's total liability for any claim will not exceed the amount you paid for the App in the 12 months before the event giving rise to the claim (or, if you did not pay, 10 EUR).
14. Termination
We may suspend or terminate access to the App if we reasonably believe you have violated these Terms or if necessary to protect the App, users, or third parties. You may stop using the App at any time.
15. Governing law
These Terms are governed by the laws applicable where Qihome is established, without regard to conflict of law principles. If required by local law, you may have additional consumer rights that cannot be waived.
